Panel Discussion - 90-Minute Facilitated Discussion
Don’t miss this 90-minute facilitated discussion led by Knox County assistant public defenders Keith Lowe, Joseph Sandford and Brooke Spivey, along with assistant federal defenders Nakeisha Jackson and Sarah Olesiuk.
A high percentage of our clients face simultaneous state and federal prosecutions. Gone are the days when we could reassure most clients that their state charges would be dismissed following a federal indictment. This session is designed to encourage collaboration around tools and strategies we can implement to meet our ethical obligations and reduce the potential harm to clients facing dual prosecutions. We hope to cover as much ground as we can in 90 minutes, including:
*Negotiating/litigating when state prosecutors refuse to dismiss charges based on a federal plea to the same or similar conduct
*Armed Career Criminal/Career Offender predicates – what to watch for
*Structuring state and federal judgments to achieve concurrent sentencing (judgment wording and timing)
*Strategies for collaborating when a new state charge is the basis for a federal probation revocation and vice versa
The session has been approved for 1.5 hours of general CLE credit.
Please register for the discussion by emailing Sandy Waggoner at [email protected].
